MANAGED SERVICE COMPANY PROVIDERS

We advise umbrella companies, and individual managed service company providers on legal and commercial requirements.

The March 2006 Budget Report declared the Treasury’s intention of ensuring that ‘all individuals and businesses pay their fair share of tax and National Insurance contributions, irrespective of legal form’, and this will include ‘action to tackle disguised employment through managed service company schemes’. This has been followed by the December 2006 pre-Budget announcement of a consultation on  the targeting of MSCs - so-called Managed Service Companies - to have effect from April 2007.


Evidence since early 2008 indicates that HMRC is toughening its stance towards expenses claims and unpaid tax recovery with targeting of various types of company models. For example it is:

  • reviewing its dispensations
  • disallowing some expenses claims
  • arguing that employees of umbrella companies are not truly employed
  • reviewing whether an organisation may be an MSC Provider, with consequent tax ramifications for client contractor companies
