These website terms and conditions govern access to a site that contain bulletin boards and that also sells services (full details of services will be within the site content). Some minor changes may be necessary to conform these terms to the services to be supplied. Where individuals as opposed to limited companies are accessing the site through the internet, data protection requirements must be covered by a separate privacy policy.
Summary
Extensive terms protect the site owner from and relating to information and material posted on the site. Disclaimers also pass on responsibility for use of this data back to third parties accessing the site. The owner is also protected in relation to copyright and other intellectual property rights of third parties. The appropriate warnings are also given in order to protect ownership of site content.
General terms are included as to liabilities in relation to bulletin boards and an indemnity for misuse is taken. A link will take users (who will be registered) to the rules of the bulletin boards.
Limitations of liability have been included to protect the site owner. These operate on several levels, for example excluding consequential and indirect loss as well as loss of profit or revenue. The last level of protection is a finite cap on damages. The site owner should, however, be aware that many statutes may operate to affect what exclusions and limitations are permissible in law.
The right is reserved to bar any user from the site at the owner’s discretion. English law is expressed to apply to the terms and statutory provisions that may increase exposure to third parties have been excluded (as is permissible in law).
