Since the onset of the Managed Service Company legislation there has been a strong argument in favour of operating an employment umbrella. Not only are workers employed, and so offering protection for both agencies and end user hirers against potential accruing employment rights, but agencies can safely recommend contractors to work through an employment umbrella without risk of third party debt transfer.

However umbrella companies face a host of obstacles. The form of employment contract must comply with statutory requirements and at the same time reflect correct operating arrangements. The manner in which expenses are handled must be appropriately reflected in documentation and at the same time be sufficient to satisfy HMRC requirements. Holiday pay arrangements must be in line with Regulations. At the same time agencies have their own requirements which must be allowed for.
