| Expenses for service providers For several years HMRC has been considering how to deal with the abuse of expense claims by some service providers in the recruitment sector. This lead to a consultation in 2008 following which the rules relating to expenses have been kept in place but new rules were formulated for dealing with dispensations.
HMRC stepped up its compliance checks early in 2009, and dispensations are under review, with HMRC reportedly throwing significant resources at the issue. Key to allowing expenses is the need to employ workers on a so called "overarching" employment contract, with obligations in between assignments.
Agencies that employ their workers ans claim expenses have also come more into the spotlight since 2008.
This issue affects all employment umbrella companies and employment businesses that employ their agency workers.
