It
is possible to operate outside IR35. However some of the solutions that
have been widely discussed since the onset of the tax law are not all
what they are cracked up to be, and have been effectively challenged by
HMRC in recent years. The case of Dragonfly is a case in point. A
contractually stated right to substitute did not save the day for
Dragonfly and HMRC romped home with a decision requiring Dragonfly to
pay out some £99000. There is a lesson in this.
To operate
outside IR35 things have to be set up correctly and the working
practices must match the contractual intention. Is this easy? It can be
