The guaranteed hours proposal is that after being supplied for a proposed 12-week reference period, hirers will be obliged to offer a direct guaranteed hours contract to an agency worker. This proposal goes to the heart of recruitment supply arrangements and is arguably the biggest threat to agency work since the AWR.
Already in legislation set to apply in 2027, this government consultation addresses and questions some of the detail, including the 12 week reference period, qualifying requirements and exclusions. Agencies have the opportunity to respond within this consultation which ends on 25th August 2026.

Theresa frequently liaises with government bodies such as the EAS and HMRC and is a regular speaker at industry events.
Peter joined Lawspeed in 2017 and advises clients on employment, contractual, and recruitment law, with a particular focus on employment status. His background includes roles at the Benefits Agency, a Law Centre, and the Incorporated Society of Musicians. He also represents clients in employment tribunal cases.
